Supreme Court to review New York flow control case

Sept. 27 -- Flow control is going back to the United States Supreme Court.
The nation´s highest court has agreed to review a 
case from New York state questioning whether laws 
in two counties violate the Commerce Clause of the U.S. Constitution.

The case, titled United Haulers Association Inc. 
verses Oneida-Herkimer Solid Waste Management 
Authority, dates back more than a decade.

The issue is whether the counties can direct 
trash flow. The local laws were struck down by a 
federal court but then upheld by a federal 
appeals court, according to the National Solid Wastes Management Association.

The case is scheduled to be heard in January with 
a decision expected by June, the NSWMA said.
